I would like to ask some advise here regarding the situation I am in with my boss here in Bahrain.

I tendered already my resignation and supposedly I will be leaving after February 2009 with the management's acceptance and approval.

Then, there was a meeting where my boss was really mad at me. Until he threatened me that instead of leaving this Feb, he will let me stay 2 years more...

Are there cases where an employee can be held for longer than the date of resignation which they accepted? Can they make a case for me to stay longer than my expected leave?

Your question is very difficult to answer with a simple yes or no.

The situation must be studied and facts must be at hand.

Perhaps, the first iniative you could do is to direct your question and seek legal assistance from the Phil. Embassy/Consulate in Bahrain.

Not unless we have a lawyer-member here in MC to give you a good advise.

I can't imagine how your employer can force you to work for them if you don't want to?

Maybe also consult with Philippine Overseas Employment Agency (POEA) and the Overseas Workers' Welfare Administration (OWWA) as well. I believe their contact information is on OFW forum.

I also don't understand how your employer could possibly let you work 2 more years in Baharin if you don't want to.

Unless you desperately need this job, which is apparently not the case, you should fire your employer right away. Going through legal procedures is very costly in terms of time and money, a kind of luxury we OFWs often lack.

Hi, hindi naman ako lawyer, pero pinagaralan namin din ang law's regarding contracts. I suppose you have a signed copy of your employment contract with your employer. The options you could avail of are commonly stated there. Try mo itong link.

Like others here, I'm also finding it difficult just to imagine under what conditions any employer can legally hold any employee against his or her wishes . . . even in a place as far-flung as Bahrain. Especially so given this worker is a citizen and national of another country, who likely never (certainly not by contract) surrenedered his or her freedom absolutely to the employer. Perhaps it's an oddity of the Middle Eastern legal system, but I doubt it.

That's slavery - pure and simple. Get legal assistance sa Philippine Embassy natin dyan. It's their job to protect OFW like you.

After 3 months, I was mentally tortured and experienced the wrath of my arab boss.

The Philippine Embassy did not help me with anything. When I went there, the arab lawyer who is working for the embassy, simply talked with my boss, but nothing happened. I asked the lawyer if they will help me if my passport will still be given to me when it expires on December 5, yet he has no definite answer. It might be because my case is simple unlike the other cases they are handling.

I finally hired an arab lawyer (private). They spoke to my boss and wrote a letter to return back my passport or else, we will sue him court.

Finally, my arab boss agreed to let me go with the condition that I won't be getting anything. I agreed, so I immediately bought my ticket. Within three days, I am back here in our country.

The experience of working in Bahrain is a lesson learned. Others may have experienced worse than mine, but I will now stick with my own country. I just hope the new two filipinas won't experience the same

Its so sad to learn that our Embassy didn't do much of a help and that you have to experience all this. So sorry!

But just look on the brighter side, You're back in our Country Safely, with your family and friends, i guess that's what matters most.
